Personal Injury

What do I do after an accident?

If you have been injured in an accident, the most important priority is getting medical attention. Assuming that you are not taken to the emergency room immediately, you should take photos or videos of the accident scene and get the contact information of any witnesses. You should not admit fault or apologize to anyone else who was involved, even if it seems like a polite thing to do. Anything that you say in the aftermath of an accident can be used against you if you pursue a claim or lawsuit later. If you suspect that someone else may have been at fault, you should set up a consultation with an attorney to discuss your options.

What Are The Different Types Of Compensation That Personal Injury Victims Are Entitled To?

Personal injury victims may be entitled to monetary compensation for the following:

  • Medical bills
  • Wage and income loss
  • Earning capacity loss
  • Pain and suffering
  • Loss of enjoyment of life
  • Punitive damages
  • Property damage
What Is The Personal Injury Legal Process in SC?
The personal injury legal process involves three steps. Step1: The first step is pre-litigation. During this stage, Adegbola Law Firm attorney will gather evidence such as police reports, witness statements, photos, and medical records and bills and attempt to settle your case for maximum compensation. If the insurance company does not pay a total that is commensurate to the damages sustained by our clients, we will proceed with the second step. Step2: The second stage is litigation. During this stage, we will conduct written discovery, take depositions, and retain experts to recreate the accident and to provide medical opinions while continuing to attempt to settle your case for maximum compensation. Once again, if the insurance company does not pay a total that is commensurate to the damages sustained by our clients, we will proceed and take the case to the third step. Step3: The third and final stage is trial. During this stage, your case will be presented to a jury who will set the amount that you are owed.
What Information Should I Obtain After Getting Into An Accident?
The Adegbola Law Firm attorneys will work with you to obtain the critical information needed to support your case.
How much is my personal injury case worth?

This will depend on the specific nature of your injuries and cannot be ascertained until your case has been thoroughly investigated. You can ask personal injury attorneys in South Carolina for a rough estimate, based on similar cases that they have handled. Any estimate that you receive likely will be vague and qualified. An additional question is how much you can actually collect, which may depend on factors such as the insurance of any at-fault parties, their assets, and your own insurance.

How long will it take to settle my claim?

Very few personal injury cases actually go to trial. The overwhelming majority end in a settlement with the defendant or an insurance company. Unfortunately, the time that it takes to reach a settlement is hard to predict and can vary dramatically. As a general rule, a claim that involves substantial injuries and a significant amount of money will take longer to settle because the insurer will fight harder over it. If the case is complex or liability is unclear, a settlement also may take longer to reach. Hiring an accident attorney sometimes can motivate an insurer to make a fair offer earlier in the process, since they know that they are less likely to take advantage of you.

Criminal Defense

What happens after a person is arrested?

Generally a person who has been arrested against a crime is brought to the police station where he/she is “booked”. This means the police will take personal, historical and biographical information. The police will use this information to determine if the individual has any warrants or a criminal history in order to evaluate whether or not he/she can be released from custody and whether the payment of a bail/bond is required. Depending upon the jurisdiction, if the authorities intend to detain an individual, the person may have a right to have their detention reviewed by a judicial official.

Does a person have to speak to the police after they have been arrested?
No, the US constitution, as well as the Federal and State laws, do not require an individual who has been arrested to speak to the authorities, with the exception of providing basic information about one’s identity. The decision of whether or not to speak to the police is a very important one and it should be evaluated with your attorney as soon as possible.
Can I win my DUI case?

A: Of course, this depends on the facts. However, whether you actually made a mistake and got behind the wheel after drinking, or have been accused of a crime that you didn’t commit, you need the assistance of a dedicated DUI defense attorney who possesses a thorough knowledge of the system, and has experience defending people both in court, and in DMV administrative hearings. Whether your idea of “winning” your case is being cleared of all charges because you were innocent, or getting the best possible situation after you made a terrible mistake, you need an attorney who will fight hard for your rights.

How Does Bail Work?
A simple way to think of bail is to imagine it as a deposit against your freedom. When you pay bail, you are allowed out of jail while you await your court dates. You are promising that you will appear in court, and guaranteeing that promise with money or property. Your defense lawyer may be able to ensure that you are able to get bail, and that that bail is as low as possible. After the disposition of your case, regardless of the outcome, you receive your money or property back, as long as you did in fact appear at all of your court dates. If you fail to appear, you forfeit the bail.
I have already been arrested and charged with a minor crime. Do I really need a lawyer if I just want to plead guilty and get it over with?

Even if you are being charged with a minor offense to which you believe you are guilty, you should always have an attorney review your case before entering a plea. Even if you are being charged for possession of alcohol, the penalties for a first offense range from hundreds of dollars in fines to 60 days in jail. Any type of conviction for drug charges will come up whenever a prospective employer runs a background check, and will also make you ineligible to receive federal financial aid for college. Adegbola Law Firm attorney may help you find defenses you did not even know were available.
