Negligence Rule Cases

Comparative negligence is a legal principle that courts use to measure the amount of damages a plaintiff can recover in an accident based on their percentage of fault.

Minnesota follows a modified comparative negligence rule which means that you will only recover compensation for your accident-related damages if you are no more than 50 percent at fault for the accident. Statute of
Limitations in Minnesota

A statute of limitations establishes the maximum deadline for an injured person to file a legal claim. If you do not file your lawsuit within this deadline, you will not recover compensation for your damages.

Minnesota law has established the following statutes of limitations for specific claims:
Personal Injury Statute of Limitations

Minnesota has a six-year statute of limitations for filing a personal injury lawsuit. This means victims of car, truck, and other accidents caused by the negligence of another party have six years after the accident to file a legal claim.

Some exceptions may shorten or lengthen this deadline. For example, the “discovery of harm” rule allows the statute of limitations to begin when you discover the damage. In some circumstances, this may come after the date of the actual incident.

Minor children injured in an accident have one year after their 18th birthday to file a personal injury claim, regardless of how young they were when they were injured.

Wrongful Death Statute of Limitations

Minnesota wrongful death claims involving negligence have a shorter statute of limitations—just three years from the date of the death. Numerous exceptions apply to this rule.
